Welcome to Plainly Cold. These Terms of Service ("Terms") are a legal agreement between you and Plainly Cold ("Plainly Cold," "we," "us," or "our"), which operates the website plainlycold.com (the "Site") and sells digital educational ebooks (the "Products"). By accessing the Site or purchasing a Product, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or buy the Products.
The Site and Products are intended for adults 18 years of age or older. By purchasing, you confirm that you are at least 18 and able to enter into a binding contract.
Plainly Cold sells educational digital ebooks (delivered as PDF files) about cold-water therapy, sold individually and as a bundle. The Products are information and education only. They are not medical advice, physical goods, supplements, devices, coaching, or a service, and they do not diagnose, treat, cure, or prevent any medical condition (see Section 8).
Products are delivered electronically. After a successful payment, you will receive access to download your Product(s) — by email and on the order confirmation page — typically within minutes. Download links may expire for security; if a link expires or you lose it, you may request a fresh link using the email address you used at checkout. It is your responsibility to provide a correct email address and to download and save your files. Delivery is not dependent on you remaining on the confirmation page.
Because the Products are instant digital downloads that you keep permanently, all sales are final once a Product has been downloaded. If you have not yet downloaded a Product, you may request a full refund by emailing payments@plainlycold.com within 14 days of purchase, and we will refund it to your original payment method. We determine download status from our delivery records. Upon any refund, your license to the Product ends and access is revoked. We may decline refund requests we reasonably believe to be abusive.
Subject to these Terms, upon purchase we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to download and use the Product(s) for your own personal, non-commercial use. You may not resell, share, distribute, publish, sublicense, or make the Products available to any third party, and you may not reproduce or create derivative works except as permitted by law. All content, text, and materials are owned by Plainly Cold or its licensors and are protected by intellectual-property laws. All rights not expressly granted are reserved.
The Products are educational content only and are not medical advice. They do not diagnose, treat, cure, or prevent any medical condition, and they are not a substitute for professional medical care. Reading them creates no doctor–patient relationship. Cold-water exposure carries real risks and is not safe for everyone. Consult a qualified healthcare professional before beginning any cold-exposure practice, especially if you have a heart condition, irregular heartbeat, high blood pressure, a circulatory disorder such as Raynaud's, or any other significant medical condition, or if you are pregnant. Stop and seek medical attention for chest pain, palpitations, breathing difficulty, numbness that does not resolve, or dizziness that does not clear. See each Product's safety chapter before you begin.
Individual results vary. We make no promise or guarantee of any specific outcome from reading the Products or practicing cold exposure. Any benefits described are general, modest, and individual. The Products are provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law.
You understand that cold-water exposure is undertaken entirely at your own risk and by your own choice. By using the Products you acknowledge the risks described in them and accept full responsibility for your own health and safety and for deciding whether cold exposure is appropriate for you.
To the maximum extent permitted by law, in no event will Plainly Cold, its owner, or its affiliates be liable for any injury, loss, or damage — direct, indirect, incidental, consequential, or otherwise — arising from or related to your use of the Site, the Products, or any cold-exposure practice, whether based in contract, tort, or any other theory. Where liability cannot be excluded, it is limited to the amount you paid for the Product giving rise to the claim.
You agree to indemnify and hold harmless Plainly Cold and its owner and affiliates from any claims, damages, or expenses arising from your misuse of the Products or your breach of these Terms.
The Site relies on third-party services (for example, Stripe for payments and an email/hosting provider for delivery) and may link to third-party sites. We are not responsible for the content or practices of third parties; their terms and privacy policies govern your use of their services.
We may update the Products, the Site, or these Terms from time to time. Material changes to these Terms will be posted here with a new "Last updated" date. Your continued use of the Site after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. You agree that any dispute will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
